Does CAN-SPAM laws sound like the most boring topic ever?

Yes.

Do you need to know it as well as you know your conversion stats?

Only if you want to avoid SERIOUS fines or worse.

Let’s see if we can inject some fun into this topic while keeping you and your business out of hot water with the U.S. government.

First of all, if you want to win bets with fellow marketers at conferences, bet them that they can’t tell you what CAN-SPAM stands for. Frankly, until I looked it up a second ago, you would have won that bet with me.

CAN-SPAM is the, “Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003.” It’s legislation passed by the U.S. Congress that regulates commercial email.

9 out of 10 marketers will tell you they know what the CAN-SPAM Act entails, until you start asking them questions. Then usually all they can tell you is this:

1. Don’t send unsolicited emails

2. Place your business address on the bottom of every email

3. Make it easy for people to unsubscribe to your list.

And that’s a pretty good answer, but it’s not enough to keep you out of trouble.

Here’s what you need to know:

· Each violation of the Act can result in a fine of up to $40,654. That’s PER EMAIL. I’m guessing I have your attention now?

· The Act doesn’t just cover bulk email – it covers ALL commercial messages, which the law defines as “any electronic mail message the primary purpose of which is the commercial advertisement of promotion of a commercial product or service, including email that promotes content on commercial websites. Whew, what a mouthful.

· Spam is defined as “unsolicited commercial email.” Thus any email you send that is commercial in nature and the recipient didn’t ask for is technically spam. Right about now there are readers thinking to themselves, “Oh #$%&, I think I may have sent spam.” Yup. If you’ve been marketing for any length of time, there’s a good chance you sent spam and didn’t even know it. That’s because…

· There is NO exception for business -to- business email. This means ALL email, such as an email asking another marketer to promote your product, must comply with the law.

Here’s a rundown of CAN-SPAM’s main requirements. I want to get this EXACTLY right so I’m going to take it right off of the FTC’s website:

1. Don’t use false or misleading header information. Your “From,” “To,” “Reply-To,” and routing information – including the originating domain name and email address – must be accurate and identify the person or business who initiated the message.

2. Don’t use deceptive subject lines. The subject line must accurately reflect the content of the message.

3. Identify the message as an ad. The law gives you a lot of leeway in how to do this, but you must disclose clearly and conspicuously that your message is an advertisement.

4. Tell recipients where you’re located. Your message must include your valid physical postal address. This can be your current street address, a post office box you’ve registered with the U.S. Postal Service, or a private mailbox you’ve registered with a commercial mail receiving agency established under Postal Service regulations.

5. Tell recipients how to opt out of receiving future email from you. Your message must include a clear and conspicuous explanation of how the recipient can opt out of getting email from you in the future. Craft the notice in a way that’s easy for an ordinary person to recognize, read, and understand. Creative use of type size, color, and location can improve clarity. Give a return email address or another easy Internet-based way to allow people to communicate their choice to you. You may create a menu to allow a recipient to opt out of certain types of messages, but you must include the option to stop all commercial messages from you. Make sure your spam filter doesn’t block these opt-out requests.

6. Honor opt-out requests promptly. Any opt-out mechanism you offer must be able to process opt-out requests for at least 30 days after you send your message. You must honor a recipient’s opt-out request within 10 business days. You can’t charge a fee, require the recipient to give you any personally identifying information beyond an email address, or make the recipient take any step other than sending a reply email or visiting a single page on an Internet website as a condition for honoring an opt-out request. Once people have told you they don’t want to receive more messages from you, you can’t sell or transfer their email addresses, even in the form of a mailing list. The only exception is that you may transfer the addresses to a company you’ve hired to help you comply with the CAN-SPAM Act.

7. Monitor what others are doing on your behalf. The law makes clear that even if you hire another company to handle your email marketing, you can’t contract away your legal responsibility to comply with the law. Both the company whose product is promoted in the message and the company that actually sends the message may be held legally responsible.

Now, I know you’re building your list with people who have ASKED to be on your list. And when they want to leave your list, you have that handy dandy link they can click.

But…

What about those times when you’ve contacted someone – say, another product owner, a business owner, a blog owner, etc., – and proposed something?

“I have this URL which is really close to yours, want to buy it?”

“I have this great product your list would love, want to promote it?”

“I have this terrific service that will bring you new business, want to look at it?”

These are all technically spam. And if reported and acted upon by the FTC, you could get into trouble.

Now, most folks will never bother to report you, even if they are miffed. But it only takes one or two to start trouble.

So in this case, what might you do?

First, I’m no lawyer. Remember that. This is NOT legal advice. But I can tell you the methods I use:

· If I get a referral from somebody, I use that referral in my initial email. “Jake told me (this and this about you) and he said I should contact you and see about possibly setting something up.” No one (in my experience) is going to mind getting this email because you’ve mentioned the mutual friend. Heck, it wasn’t even your idea.

· I don’t ask for what I want in the initial email. Frankly, I might not ask for days or even weeks. Instead, I focus first on building a relationship. “Hi Ellen, I see you’re in the __ field and I just wanted to introduce myself.” No one ever has enough professional contacts, so this nearly always gets a positive response.

· I give them kudos for something they’ve accomplished. “Rashim, I just finished reading your book and I loved it. Here’s what you taught me (Here I list my 3 biggest takeaways). Anyway, just wanted to thank you for writing this great book, I’m going to recommend it to my fellow marketers.” This nearly always gets a response.

In any email I send, I put my contact info including website, social media and Skype. Whether I ask them to contact me or not, they almost always do, and usually it’s by email after they’ve checked out my website.

Out of respect for their time, I keep initial emails short and to the point. I don’t solicit. I do close with something like, “If I can be of help to you, please let me know.”Don’t worry about offering your help – professionals generally don’t take advantage of each other, and if they were to ask for something crazy, you could always say no.

If I had to sum up how to send an unsolicited email to a fellow marketer in three words, it would be this:

Make it personal.

When you’re mentioning a mutual friend, complimenting them on something they did, or simply reaching out to meet a fellow marketer, no one in their right mind is going to get upset or cry foul, at least in my experience.

Steps to Install Flexible LED Strip Lighting with Solderless Connectors:

1. Materials Needed – Have all your materials ready. You will need scissors, LED flexible strip lights, a connector, ruler (if needed), and a set of hands.

2. Measuring how many feet of LED strip you need – You may have your LED strip light sent to you in a roll (16 feet) or by the foot, depending on the quantity ordered. Decide how much flexible LED strip lighting you will need for your project. Since the LED strip can only be cut every third LED, you may have to go slightly over or under your desired specification.

3. How to cut the LED strip – As you can see below, the flexible strip light can only be cut along the designated lines. Take a sharp pair of scissors and cut along the line.

4. Pay attention to positive and negative markings – IMPORTANT: Notice the positive and negative sides of the LED strip light. This is important for the next few steps. Sometimes when you cut the LED strip light, things can get mixed around.

5. Introduction to the connector – Each connector has two sides. To insure you have the correct side up, make sure the wider of the white sides faces up. This is the top. BE GENTLE and pull the locking device out away from the wires. Do not pull on the wires to do so, as the connector is fragile.

6. Attaching the connector to the LED strip – IMPORTANT: Color does not always matter! Make sure you follow the positive side of the flex strip down through the connector wire to the power supply. Red/black can either mean (+) or (-) depending on what side you have hooked the connector to.

7. Securing the tray to the LED light – In the example below, if we were to attach the connector to the other side of the flexible strip light, the red would be negative and the black positive. Next, GENTLY secure the locking tray back in place, connecting the terminals of the LED flexible strip light to the connector. Be gentle and make sure the mounting tray is securely closed, or the lights will not work.

8. Connecting the LED strip to power – You are now ready to plug your LED Flexible strip light to the LED power supply. Match the positive and negative markings with the positive and negative wires from the power supply. Make sure the power is off when you do this.

If your strip lights do not light up:

1. Wire color does not always matter! Make sure you follow the positive side of the flex strip down through the connector wire to the power supply. Red/black can either mean (+) or (-) depending on what side of the LED flex strip you have hooked the connector to.

2. Another common problem is that the connector may be installed upside down; repeat steps above and try again.

3. Also, MAKE SURE the tray is closed all the way. Be gentle!

4. Check your power supply and make sure it is hooked up properly, with correct (+) and (-) as well.

5. How many feet of LED strip are you using vs how large your power unit is? If you are using 1 reel of 24 v Ultra bright with e 2.5 amp power unit, it will not work because the power unit is too small.

How Long Does it Take to Paint a Wood Window?

Well it’s all going to depend on the size and the design of the wood window, but you can plan on spending quite a bit of time, painting these intricate architectural items.

Let me give you an idea, I had to paint 7 wood windows, one time and these didn’t have any architectural details to them, they were simply plain old wood windows. The type of windows that were installed through out the 1950s and would need to be replaced or repaired, in the near future.

You’re going to find this hard to believe, but I used to paint the outside of the house, a small house, for $300, and a homeowner would supply me with the paint. I had to buy the rest of the materials, but I could paint the exterior of these small homes, in about a day and a half.

Except for the wood windows, this was a totally different story and I wouldn’t paint the wood windows each time I painted the house. I would often touch the windows up, but the amount of time that it would usually take me to paint these windows, was unbelievable.

Keep something in mind here, I could paint the entire house in about 12 hours, but it would take me about the same amount of time, just to paint the exterior of these windows and more than half of them wouldn’t open, because they were previously painted shut.

If the wood window has any sort of architectural detail, or any grids or divided lites, you could plan on spending quite a bit of time, painting each window. If you’ve never painted a wood window before, plan on spending at the least four to six hours, for window smaller than 3′ x 3′ and plan on spending at least eight to 12 hours, or more, for larger wood windows.

The activity assessment determinates the content of the care plan. Not all tenants will have an "activity-care plan", but most care plans should have "activity-related interventions" found in the comprehensive care plan. Care plans may be written regardless of if a resident triggers on the MDS 2.0.It is important to set realistic, measurable goals, interdisciplinary interventions, and create care plans that are individualized and person-centered.

The loan companies are also cashing in on ignorant and naive individuals and this really concerns me. The advertisement marketplace is going wild on media adverts for consolidation loans. You know the type? “We will help you to consolidate all of your existing loans into one affordable monthly payment” They call this type of loan a HOME OWNERS loan. Yes you can consolidate all of your existing debts into one affordable monthly loan, but what do you call affordable? People are consolidating their present debts into one huge debt and loaning the money to repay this new debt. To actually repay this debt in full will take these people years. What’s more they’ve secured this loan on their one and only ASSET – their HOME!

These unfortunate people aren’t thinking about the future and their long-term future plans, they’re thinking about the immediate and present situation. In the meantime what happens when the interest rates begin to rise? The interest rates on a consolidation loan will take years to pay off and whilst you owe money to your lender you’re not secure at all because your consolidation loan is secured on your home.

If you have a current ‘interest only’ mortgage of say £100k and the interest rate applied is £5% your monthly payment will increase with the interest rate. What happens if the interest rate climbs to 10%? Your mortgage could double. In 1989 the interest rate sawed to 15%. If this happens (and it could) your present mortgage payments could treble! How will you survive financially?

Your mortgage payments could increase by 300% inside 12 months and any other loans you may have will also require payment. If your wage doesn’t allow sufficient funds to meet these demands than you will lose everything slowly and painfully. When the interest rates do begin to rise (and they will) the debt consolidation companies will cash in on you. Before you know it you could owe money for the rest of your life and if you can’t pay what you owe than your lender will take your car your home and the clothes off your back to meet their demands.

SO WHAT’S THE ANSWER?

My advice to you is to pay off your existing debts as quickly as possible. If you are driving around in a car that is financed by a finance company pay this loan off as quickly as possible. Contact the finance company and ask them for a final settlement figure. This way you’ll know exactly how much debt you’re in. If you can afford to settle your finance early than take advantage of this and settle immediately. This way you’ll own your car outright, you’ll have paid less in interest and you’ll have some equity if you need it. If you can’t afford to settle the finance at the present than check what interest rate you are currently paying and search around on the Internet or in the high street for a lower rate of interest. Whatever you do, don’t delay in taking control of your finances today.

Another mistake people make is to fall into the trap of ‘false economy’. They begin with the right intentions by searching for a lower rate of interest for their mortgage. What this means is that their monthly payments become lower. The mistake they make is to think they’ve got more money in their pocket. In affect this is a false economy. Instead of settling for more money in your pocket and still enduring a 10 year (or whatever) term loan ,why not use this extra money to increase payment on the capital of your loan?

Don’t settle for a lower rate of interest and extend your loan payments thinking that you’re saving money, you’re not. You are only extending your debt! You need to pay off this loan as quickly as possible whilst the interest rates are low. The longer you take to pay off your mortgage the more interest rate the Bank or Building Society will take from you. Whilst the interest rate is currently around 5% accelerate payment NOW and save even more money! Take advantage of the fact that if the interest rates are currently low than the amount of interest that you pay on top of your loan will be also low. If you can afford to increase payment whilst the rates of interest are low than I urge you take advantage of this immediately. If there is any way that you can accelerate your loan and pay it off early than I would strongly advise you to begin your financial organisation here and organise this today. A simple increase of £50 per month in mortgage payments will save you money in interest payments in the long run. Your first step to taking control of your financial world is to pay off all of your existing debts as quickly as possible. When you have no debts, you’ll be financially free and you’ll feel as if a huge weight has been lifted from your shoulders.

Talking of your mortgage, if you currently have an Endowment policy running alongside your mortgage than investigate this policy thoroughly. Most endowment policies are useless in today’s interest market. What this means is that when your mortgage term ends there may be insufficient funds in your endowment policy to pay off what you owe to the lender. If this is true than your lender will be knocking on your door for this short fall. If you can’t afford to pay than you could lose your home after 25 years or more of payments! Recently I read that some Endowment policies were running a short fall of up to £13000! If this happens to you you’ll owe your lender £13k plus interest!

The smartest mortgage you can take is a straight ‘repayment’ mortgage. As well as paying the interest back to your lender you are also paying the capital off from the offset, therefore reducing the total amount you owe quicker. My advice is to accelerate your mortgage and pay it off as quickly as possible before the interest rates sky rocket and your payment doubles or even trebles. When the tide turns (and it will) you’ll be smiling in the content that you own your home and you own your car and nothing can take these away from you.

what types of documents are on your machine that it can

manipulate. It can “see” practically anything that’s a part

of the Microsoft Office Suite, for example.

The program was also “seeing” PDF converters that I had

downloaded and installed on my laptop when I was working

ONLY available in PDF that I needed in Word format so that I

could update them. These were generally documents that I

had created or purchased the rights to change them, but that
