There are different types of constitution but the type adopted by a country is determined by her structural composition and the system of government practiced by that country. Nigeria, for instance, adopts a federal constitution because of her pluralistic structure.

The focus of this article is to examine how constitutions are made. However, there are preliminary issues to be first dealt with in order to achieve the primary objective.

What is constitution?

Wade & Philips in their book “constitutional law” defined constitution as ‘a document having a special legal sanctity which sets out the frame work and the principal functions of the organs of government of a state and declares the principles governing the operation of those organs”.

Though the above definition rendered by the two acknowledged authorities on constitutional matters captures the essence of a constitution, it suffers a pitfall by defining a constitution merely as a document. There are constitutions that are found in more than a single document. And in fact, some countries’ constitutions are unwritten. The Great Britain and New Zealand are classic examples of countries with unwritten constitutions.

In a nutshell, a constitution is a body of set rules which defines government powers, functions and citizens’ rights and duties in a definite political space. It may be codified in a single document like the United States of America’s constitution or made up of conventions which are contained in different documents as used in Britain. Habeas Corpus and certiorari in the U.K are examples of conventions with constitutional appeals.

Types of Constitution

There are basically 3 types of constitution and these are:

  • Unitary constitution
  • Confederal constitution
  • Federal constitution

Unitary constitution

A unitary constitution is the one that vests supreme legislative power in one authority in a given state. This type is usually adopted in a polity where the people are homogeneous. One authority is recognized and every citizen is subject to it.

Confederal constitution

It is a constitution that vests the regional components with overwhelming legislative powers and makes the central authority weak. This constitutional arrangement makes secession on the part of the component units a viable option. This model is quite unpopular worldwide.

Federal constitution

In this case, the structure of the country is divided into two: regional government and central government. Regional government represents the various states that have come together to form a united country and the central government is the national headquarters of government.

So a federal constitution is one that recognizes the division of a country into two. That is, the regional governments and the central government but each is made independent and autonomous to the other. Legislative powers are also divided into two and for the purpose of sustaining the union, the central government is accorded more powers, while less powers are given to the various states. This constitution is best suitable for countries with cultural diversity.

The Making Of A Constitution

Constitution, unlike other laws, is not to be enacted by the law-makers. The law-makers can amend a constitution. They cannot make it. The most widely acceptable mode of making a constitution is by the people who are to be governed by the same constitution. A Respected Nigerian professor of constitutional law, Ben Nwabueze, says this “A constitution is an act of the people if it is made by them either directly in a referendum…or through…….a constituent   assembly …”

A constituent  assembly  is a body of elected representatives of the people given mandate to make a constitution and nothing more. It is the duty of this body to fashion out a constitution which would reflect the wishes of the people. The  assembly  has a duty to revert to the people for approval of their assignment in a referendum. A constitution enacted in this fashion is said to be autochthonous, meaning one which derives its force from the people- its subjects.

The sole reason this method of constitutional making is the most acceptable is simply because it promotes the expression of the popular will. The people can identify with the constitution because it is a true reflection of their wishes and aspirations. Constitutions that have endured the world over are products of this procedure.

Conscious of the respect this method of constitutional making commands globally, the drafters of the 1999 Constitution of the Federal Republic of Nigeria inserted the following preamble:

Cutting to size. Use a sharp panel saw, Tenon saw, laminate cutter or trimming knife, taking care to give adequate support to the off-cut to avoid cracking the surface. Always cut laminate sheet with the “face side” up. Cut slightly oversize this will help precision edge trimming.

Your local dealer will supply surfacing ready cut, if you prefer to supply dimensions. This would make it easier for you than buying standard sheets or panel sizes and cut them yourself.

Preparing the surface. Laminate sheet should never be bonded directly on to solid timber. This may cause warping. First, cover timber with hard-board or plywood by nailing and spot gluing. Particle-board, hard-board, plywood or core-stock are all ideal surfaces for direct bonding, and the sheeting may also be bonded successfully with contact adhesive to plaster. Always be certain that surfaces are clean, dry and free from grease, soap scum or similar deposits. The edge of base surfacing should always be flat and smooth to allow for effective finishing.

Bonding. Spread an even film of contact adhesive on both the sheet and the surface – using the special applicator supplied with the adhesive. If the surface material is porous, it may need two coats.

Allow the applied contact adhesive to dry for about 20 minutes, perhaps a little longer in cold weather. Test dryness by touching with your knuckles. When adhesive does not transfer to your knuckles, it is time to fix to the surface. Do not fix while adhesive is still tacky.

Positioning. Because contact adhesive bonds immediately on contact, it is important to line up one edge and one corner of your laminate surfacing very carefully ensuring a correct positioning. For large areas, precise alignment you will achieved by using dowels or thin timber strips to separate the adhesive coated surfaces. When accurately aligned, remove the dowel at one end and press laminate against core material. Carry on along the length, removing the dowels one at a time until you have removed them all.

Fix by using a rolling-pin or a cork padded wood block to protect the surface and tap firmly with a hammer ensuring a tight, even bonding.

Finishing. The edge of the base and surface material you need flat and smooth so that it will give you a perfect edge finish with the sheet. Allow 30 minutes for adhesive to dry out, then trim overhanging edges with a plane or file. Cut edge strip slightly oversize. Apply adhesive to both strip and edge surface. Important to Remember, that porous base materials may need two coats of adhesive. Allow adhesive to dry, and fix as directed for large areas. Hammer firmly, using the cork block to protect surface. Trim the oversize portion of edge strip with a sharp plane or file to give a bevel to the top edge and corners.

Clean surplus the adhesive by rubbing firmly with your fingers when completely dry.

Shovel Pain Free This Winter

As another winter season sets in here at the New Jersey shore (Bradley Beach), I see more and more people walking around the gym like there crippled because they hurt there back  shoveling  snow.

I am going to give you my top 4  shoveling  secrets today. These secrets are not just limited to snow, they apply to dirt, sand, and gravel as well. Furthermore, you never know when you are going to get snow as it snowed for the first time in 25 years in Las Vegas of all places.

1.) Don’t forget to warm up

Just as I do with every single client before a training session or a boot-camp class, perform a proper warm up that raises core temperature, excites the Central Nervous System, and stretches tight areas. The most common injuries I see are low back and shoulders and this is usually due to overly tight hips and chest.

Exercise#1- Reverse lunges (reach way back, chest up)

Exercise#2- Jumping jacks 3 ways (overhead, middle, low)

Exercise#3- 10 x push ups

Exercise#4- 10x squats

Exercise#5- Hip rolls (lay down face up knees together and let them fall to ground on both sides)

2.) Use a split stance when  shoveling 

The most common complaint of most people when  shoveling  is a sore/tight lower back. This usually is caused by tight hips causing too much flexion in the low back which leads to spasms and then possibly herniated discs. The warm up listed above will help. Also, try to split your stance with one foot forward, instead of keeping parallel feet. Make sure to alternate feet every so often and work both sides.

3.) Face your toes in the Direction that your  shoveling 

Even though you now have a split stance, the combination of back extension with rotation ( shovel  toss over shoulder) can leave you susceptible to injury. Minimize spinal rotation by pointing toes in the direction that your  shoveling .

4.)  Shovel  to both sides

Don’t just  shovel  to your strong side! By doing an equal amount to both sides, you are going a long way in preventing over use injuries and preventing the muscular and flexibility imbalances that are common place from  shoveling !

These tips will go a long way in preventing nagging injuries this time of year. Although its not fun to get hurt  shoveling , this type of injury is usually a sign being overweight, weak, and de-conditioned.
