Can a Legistor Cross Carpet and Still Keep His Seat Under Nigerian Law?

Our chief concern here is to discuss the legal consequences of the current spate of party defection by members of the Peoples Democratic Party (PDP) to the All Progressive Congress (APC). We shall leave the task of recounting Nigeria’s history on carpet crossing to historians and shall not be bordered by it. We shall also not allow ourselves to be drawn into arguments as to the morality/propriety of carpet crossing.

The media is awash with the news of the defection of 37 PDP members of the House of Representatives to the APC. Already, five PDP governors have dumped the party for the APC. The collapse of the PDP as the ruling party in Nigeria and as Africa’s biggest political party seems imminent as unconfirmed reports say that twenty-two senators are planning to also dump the party for the APC.

Nigerian law on carpet crossing begins and ends with the provisions of Sections 68(1)(g) and 109(1)(g) of the 1999 Constitution of the Federal Republic of Nigeria. These sections provide that:

“a member of the Senate or House of Representatives or State House of Assembly shall not vacate his seat in the House of which he is a member if being a person whose election into the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which the House was elected.

Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member of a merger of two or more political parties by one of which he was previously sponsored.”

It is interesting to note that unlike the purport of above provisions, Sections 135 and 180 of the said Constitution which provides for circumstances under which the President or his Vice, and a Governor or his Deputy could cease to hold office does not mention party defection as a ground for vacating or ceasing to hold office.

From the above provisions therefore, Nigerian law on carpet crossing could be summarized as follows:

1. A Legislator in Nigeria could lose or vacate his seat in parliament if he defects from the party that sponsored him into the Legislative House to another party.

2. A Nigerian Governor, Deputy Governor, President or Vice President cannot vacate or cease to hold office for defecting from the political party that sponsored him into office to another.

3. Before a Legislator in Nigeria could be made to lose his seat in parliament for defecting to a party other than the one that sponsored him into the House, the principal officer of that Legislative House( the Senate President, the Speaker of the House of Representatives or the Speaker of the State House of Assembly as the case may be) or a member of that Legislative House must first present evidence satisfactory to the Legislative House concerned that a member has defected from the political party that sponsored him into the House to another political party and has by operation of law vacated his seat in Parliament.

4. It follows from the above that if there is no satisfactory evidence presented to the Legislative House on a member’s defection, the member who is alleged to have defected can still retain his seat. He will however continue to be known and addressed as a member of the party that sponsored him into the House.

5. A Legislator in Nigerian can cross carpet to a party other than the one that sponsored him into the House and still keep his seat if he can prove that his defection was as a result of a division within his former party.

6. Also, a Legislator in Nigeria will not lose/vacate his seat even though he has defected from the party sponsored him to another party if he can prove that his membership of a new party is as a result of a merger of two or more political parties or factions by one of which he was previously sponsored.

The position that while a Legislator in Nigeria is liable to lose his seat in parliament for cross carpeting to another party, the President, Vice President, Governor or Deputy Governor is not liable and cannot be forced to vacate or cease to hold office for the same reason was endorsed by the Nigerian Supreme Court in the case of AGF V. Atiku Abubarkar (2007)4 S.C (pt.11)62 where the issue before the court was whether the Vice President’s defection from the PDP( on whose platform he was elected into office) to the Action Congress of Nigeria(ACN) meant that he had automatically vacated and ceased to hold that office.

The Supreme Court held that it is only Legislators that are liable to vacate their seats in parliament for defection to a different party from the one that sponsored them into office. The supreme held that the constitution does not envisage or provide for the vacation /cessation of the office of the President, Vice President, Governor or Deputy Governor for defection from the party that sponsored them into office to another party. The Apex court held therefore that Vice-President Atiku Abubarkar was entitled to keep and/or in office even though he had effected from the PDP to the ACN.

Again, the position that a legislator may lose his seat in parliament for cross carpeting to another political party has been affirmed by the court in some decisions. For instance, the Federal High Court of Nigeria sitting in Akure in the case of Hon. Ifedayo Sunday Abegunde v. The Ondo State House of Assembly & Ors. sacked Mr. Abegunde, a House of Representatives member representing Akure North and South, Ondo State for defecting from the Labour Party to the ACN. Mr Abegunde had been elected into the House under the auspices of the Labour Party in the April 2011 General Elections. He however, defected to the ACN during the currency of the tenure of the House. The court held that Mr Abegunde had vacated his seat and ceased to be a member of the House by operation of law. This decision was affirmed and upheld by the Court of Appea in Re Hon. Ifedayo Sunday Abegunde v. The Ondo State House of Assembly & Ors. (2014) LPELR-23683(CA),Appeal No.CA/AK/110/2012.

Again, in the case of Hon. Michael Dapialong v. Chief (Dr) Joseph Chibi Dariye, Appeal No. S.C 39/2007 the Supreme Court took judicial notice of the fact that between 25th and 26th July,2006, fourteen members of the twenty-four members of the Plateau State House of Assembly including the Speaker and the Deputy Speaker thereof defected from the PDP platform on whose they were elected to the House in 2009 to the Advanced Congress of d Democrats(ACD) as a result of which the said 14 members were held to have vacated their seats by operation of law.

Relying on the Supreme Court decision in AGF V. Atiku Aburbakar therefore, we can safely conclude that the five PDP Governors that had defected to the APC can validly do so without being liable to vacate or cease to hold their offices. This is because the Constitution simply does not penalize the President, Vice President, a Governor or Deputy Governor who dumps the party that sponsored him into office for another party. Also, unlike Legislators, these members of the executive arm of Government are not required to proffer explanations or reasons to justify defection.

However, some persons have argued that even though the Constitution does not penalize defection by Governors, the Supreme Court decision in Rotimi Amaechi v INEC Appeal No. SC 525/2007 could be relied upon to effect the vacation from office of Governors who defect from the parties that sponsored them into office to another political party before the expiration of their tenure. Acording Mr Dan Nwayanwu, Chairman of the Labour Party of Nigeria, the Supreme Court’s dictum in Amaechi’s Case to the effect that it is the political party and not the candidate for which the electorate cast their votes could be interpreted and applied to mean that Governors who get elected into office only to dump the party that sponsored them into office for another party should vacate or cease to hold office upon defection.

Mr Dan Nwamyawu in an interview granted to Sunday Trust Newspapers in 2007 advocated that Governors who defect to parties other than the ones that sponsored them into office should be kicked out of office on the basis of the decision in Amaechi v. INEC. We humbly disagree with this position. This is because the Constitution does not impose any penalty or legal disability on carpet crossing by Governors. Secondly, the Supreme Court in Amaechi’s Case did not decide the issue of the consequence of a Governor’s defection from his party. Rather, the question in Amaechi’s case was whether a person who did not contest an election could be heard to challenge an election or be declared as Governor. The decision in AGF V. Atiku Abubarka for all intents and purposes remains the authoritative exposition of the law on party defection in Nigeria.

It is by now beyond doubt that the five PDP governors who had defected to the APC are entitled to do so without any attendant penalty or legal disability. But can the same be said of the 37 members of the House of Representatives members who have defected to the APC? Can they validly dump the PDP for the APC without losing their seat in parliament?

By a letter addressed to the Speaker of the House of Representatives, titled ‘Communication of Change of Political Party’ and dated the 18tth December, 2013, the 37 defecting Federal Lawmakers explained that their defection from the PDP to the APC was as a result of the internal crisis within the PDP. The Lawmakers also premised their defection from the PDP to the APC on the fact that the PDP has broken into two factions: the New PDP and the Old PDP. The so-called New PDP consisting of the dissatisfied and disgruntled members of the party, the majority of whom have defected to the APC.

It is to be recalled that in Agundade’s case, he had argued that given the internal crisis, division and factionalization within the Labour Party, he was entitled by virtue of the proviso in Section 109(1)(g) of the 1999 Constitution to defect from the Labour Party to the ACN without losing or having to vacate his seat in the House. The court however ruled that since he could not prove division or factionalization within the Labour Party, he was not entitled to keep or retain his seat after he decamped to the ACN. That he vacated his seat upon defection to the ACN by operation of law.

The proviso to the provisions of Section 68(1) (g) and 109(1) (g) of the 1999 Constitution are to the effect that although a Legislator would ordinarily lose his seat if he defects to a party different from the one that sponsored him into the Legislative House, he is entitled to keep his seat if he can prove that:

1. He defected to a new party as a result of division within the party that sponsored him into the house.

2. His membership of the new party is as a result of the merger of two or more political parties or factions by one of which he was previously sponsored.

Before we proceed to examine whether the internal crisis rocking the PDP falls within the proviso to Sections 68(1)(g) and 109(1) (g) of the Constitution, it is pertinent to determine what constitutes division in a political party. The constitution does not define word “division”. The Oxford Advanced Learners Dictionary of Current English, 6th Edition, defines division as a disagreement or difference in opinion or way of life etc especially between members of a society or an organization.

According to Professor Okey Okon of the South Central University, California, USA, division could arise from:

1. Ideological differences and

2. Organizational differences.

Organizational differences denote conflict, division, crisis etc arising as a result of the way and manner the party is run, operated or managed. In fact, all conflicts and crises arising from the management and operation of the organic structure of the political party fall under the category of organizational differences. Conflict, division or crises arising from organizational differences bordering on such issues as internal democracy mechanism of the party, conduct of primaries election, funding, election of principal officers of the party, adoption of candidates as party flag bearer for election, handling of party finances, planning and execution of election campaign strategies etc come under organizational differences.

It is a notorious fact that the PDP has from inception been bedeviled by internal crises caused by the occurrence of undemocratic practices within the party. The defecting 37 Federal Legislators have alleged that their defection from the PDP to APC was as a result of division and internal crises within the party and that they are entitled to keep their seats in parliament. We do not know the particulars of the alleged division or crises within the PDP but if their allegations are true then they are entitled to keep their seats in parliament.

We shall now turn our attention to the issue of whether ideological differences constitute division as to entitle a defecting legislator to retain his seat in parliament. Ideological differences relates to conflict, disagreement, crisis or division arising from a conflict between a party member’s ideas, beliefs, conviction, principles, philosophy or policy with those of his political party. When a member disagrees with his party’s ideas, policies, programs, philosophy or principles on socio- political or economic issues does this disenchantment or disagreement with his party entitle him to defect to another party without having to lose/vacate his seat in parliament? Does this conflict or disagreement with his party constitute division as envisaged by the proviso in Sections 68(1)(g) and 109(1)(g) of the 1999 Constitution?

Professor Okey Okon is of the opinion that ideological differences constitute division within the meaning of Sections 68(1)(g) and 109(1) (g) of the Constitution and at such empowers a Legislator to defect to another party without losing his seat whenever he disagrees with the policy and philosophy of his party. According to the learned Professor, ideological differences are a form of division which should justify a legislator to defect to another party without having to lose or vacate his seat. He opined that any interpretation of the law to exclude ideological difference as constituting division is erroneous. The learned Professor further posits that failure to treat ideological differences as division will deprive Legislators of the sense of safety and protection they need to stand up for what they believe in. He held that such a narrow reading of the law will provide perverse incentives for Legislators to emphasize compliance at the expense of principles and conviction to expediency.

We however beg to disagree with this position. With due respect to the learned professor, the proviso to Section 68(1) (g) and 109(1) (g) of the Constitution cannot be objectively interpreted to mean that whenever a legislator disagrees with the policy or philosophy of his party on socio-economic political or other issues he can dump his party for another party and still retain his seat in parliament. Such an interpretation of the law cannot be the intendment of the drafters of the Constitution. It is important to note that the relevant provision reads… “As a result of a division in the political party”… This shows clearly that what the law envisages is a situation where there is a conflict or disagreement within the party that leads to internal crisis or instability in the party. In other words, ideological differences alone cannot justify defection.

However, for ideological differences to justify defection, they must be of such magnitude and intensity as to lead to crisis, instability, factionalization and conflict within the party. The Noscitur Associis rule of construction of statutes states that the company a word keeps suggests its meaning. The word “division” as used in Sections 68(1)(g) and 109(1) (g) of the 1999 Constitution are accompanied by the words “merger” and “factions” which words denotes a change or alteration in the organic structure of a political party. We therefore agree with Professor Okey to the extent that ideological differences can constitute division which can justify defection only when such differences are of such magnitude and intensity as to lead to instability or crises within the party. A mere difference in opinion or belief will not suffice to justify defection.

Indeed, legislators do not have to defect to a new party to express or hold opinions or views contrary to those favoured by their party unless of course doing so would result and actually results to instability and crisis/conflict within the party. It is submitted that to allow defection merely on the ground that a legislator disagrees with the policies or ideological position of his party on certain socio-economic cum political or moral issues would defeat the intention of the framers of the constitution. The constitution clearly intends to discourage and penalize legislators for defection except on rare and exceptional circumstances. Making mere differences in opinion and belief a ground for political defection would provide legislators an excuse for political prostitution.

It is interesting to note that the 37 defecting legislators have also sought to justify their defection on the ground that the PDP was divided into two political parties; the old PDP and the new PDP which consist of the defecting and disgruntled member. They alleged that the new PDP has formally merged with the APC. We are of the opinion that if these allegations are true then the 37 defecting legislators are entitled to so defect without having to lose their seats. It is pertinent to note that the PDP has obtained a court order declaring the so-called new PDP illegal and restraining its members from parading themselves as PDP members. The question that arises from this development is, what is the legal effect of this order on the rights of these defecting legislators to keep their seats. It is our humble opinion that the court order has no effect whatsoever on the rights of the defecting legislators to keep their seats. The order merely prohibits the use of the name PDP by the defecting faction. It does not mean that the defecting faction is an illegal group because they are not a group of criminals or bandit.

Indeed, Sections 39 and 40 of the 1999 Constitution guarantees the right to freedom of expression as well as the right to freedom of association. The court order therefore cannot operate to deprive or in any way prejudice the defecting members’ entitlement to keep their seats.

The PDP has reacted to the defection of its member, especially the 37 Federal lawmakers by saying that any member of the party that renounces its membership of PDP shall be made to vacate his seat. There are also reports in the media that the PDP has gone to court to obtain a declaration for the vacation of the seats and offices of the defecting legislators and five governors. Let’s keep our fingers crossed as we watch the drama unfold.

How To Install Laminate Countertops

The first step is to prepare the surface area for the laminate sheets.

The fourth step is placement of the laminate sheets onto the surface area.

This must be done very carefully. The bonding strength of contact cement is between 50-70% at first contact. So positioning the laminate sheets perfectly before they do contact is a must. You can do this by using strips of wood, dowel rods or wrapping paper.

  • Place strips of wood or dowel rods roughly a foot apart adjust if laying a larger laminate sheet. Or place wrapping paper over the surface area. (This step is not needed when placing laminate sheets onto vertical surface.)
  • Place laminate sheets onto surface area, once the placement is perfect then remove strips of wood, dowel rod or wrapping paper.
  • Use a roller to go over the entire surface, make sure that the plastic laminate is sealed tightly to the surface area this will also help ensure any air pockets are removed. For this task you can also use a wooden block or mallet, it's recommended to start from the center and work out using these tools.
  • If you need to make a seam place the larger laminate sheet over the smaller sheet. Cut through the sheets cleanly at the exact point that they overlap then remove the excess laminate.

The fifth step is placement of laminate sheets onto the edges.

  • Measure edges and cut out laminate sheets accordingly. Remember to cut sheets out with a few extra centimeters to ensure they cover the surface you can trim and customize the sheets later.
  • Apply two coats of contact cement onto surface edge.
  • Apply one coat of contact cement on to plastic laminate strips.
  • Allow the contact cement to dry for the recommended time provided by product instructions.
  • Carefully place laminate sheets aligning the sheet perfectly to the top of the counters edge.

Go slowly and press firmly to ensure the sheet is sealed to the surface at all points.

The sixth and last step touch up and clean your new countertop.

  • Allow the contact cement to fully dry.
  • Trim off any excess laminate on the edges using a router with a special blade for laminate, you can use a file if the excess is small. Be careful and go slowly when cutting the excess laminate, a slight miscalculation could crack the laminate sheets.
  • Clean any excess contact cement using a special solvent, if you do not have the solvent you can also use nail polish to remove it.

FOLK ART

In 1855, a hotel entrepreneur built a new inn on Rex Avenue. To draw attention to his hostelry he constructed an Indian from old barn boards and propped it up on top of a rock overlooking the Gorge. In 1902, when the Indian Rock Hotel was long gone but with the silhouette still there, artist Massey Rhind was commissioned to make a representation of a “Delaware Indian, looking west to where his people have gone.” The kneeling warrior has gazed up the Wissahickon Gorge ever since. A switchback trail leads to the Indian Statue where you can get close enough to pat his knee. And take in a breathtaking view.

MONUMENTAL M0NUMENTS

The Multi-Use Trail rolls past reconstructed huts and parade grounds that transport you back to the Revolution. The National Memorial Arch, a massive stone tribute dedicated in 1917, stands out along the route. The inscription reads: “Naked and starving as they are, we cannot enough admire the incomparable patience and fidelity of the soldiery. Washington at Valley Forge, February 16, 1778.” In the southern part of White Clay, reached by the Twin Valley Trail, is the Arc Corner Monument marking one end of the 12-mile arc which forms the Pennsylvania-Delaware state line, unique in American political boundary-making. The circular divide dates to William Penn’s directive of August 28, 1701, when Delaware was still a part of Pennsylvania, known as the Lower Three Counties. A little more than 1/2 mile to the west is another monument marking the tri-state junction of Delaware,Pennsylvania and Maryland.

AMERICAN CASTLES

Breaking out of the woods at several points on the hilltops you are greeted with an unparalleled view of Granogue, one of the more spectacular of the American castles dotting the Brandywine Valley’s chateau lands.

MOVIE LOCATIONS

Flying concentric circles outward from Philadelphia, Hollywood location scouts for Oprah Winfrey’s movie project, Beloved, spotted the Fair Hill terrain and selected it as the backdrop for the film’s rural scenes. A ramshackle 19th-century tenant farm was constructed and much of the movie shot here. The producers decided to leave the movie set intact, to deteriorate naturally. You can wander among the fake buildings and even knock on the styrofoam stones.

COOL FORTS

Where else can a dog climb into an actual battery and scan the Delaware River where gunnery officers once aimed guns capable of accurately firing 1,000-pound projectiles eight miles like he can at Fort Mott State Park? Fort DuPont, named for Civil War fleet commander Admiral Samuel Francis duPont, saw active duty in three wars before becoming a state park. The 1-mile River View Trail, a grassy loop path, begins in the marshland along the Delaware River and finishes in shaded woodlands. The trail takes you past several ruins of the military installation, camoflauged to river traffic, and features sustained views of the Delaware River and Fort Delaware on Pea Patch Island.

REMARKABLE BRIDGES

In the farthest northern section of Tyler State Park is the longest covered bridge in Bucks County. The 117-year old Schofield Ford Covered Bridge burned in 1991 but after five years of fundraising the 166-foot, two-span crossing was entirely rebuilt by volunteers on its original stone abutments using authentic period materials and methods. An elaborate, reinforced wooden railroad trestle bridges a ravine on the Glen Trail. The trail runs by a stream under the trestle and there are sweeping views of Wenonah Woods from the top.

A walk through Brandywine Park provides a quick lesson is the history of bridge architecture. The classical arch form is represented in grand style with the magificent stone viaduct across the river and numerous reinforced concrete spans. There is even a small iron arch bridge over the mill race. A prototypical 19th century pier and girder iron bridge transports trains over the Brandywine. And the pedestrian footbridge across the water, the Swinging Bridge, is a little suspension bridge employing the same engineering principles as the mythical Brooklyn Bridge.

A floodplain is a safety valve for the release of a raging creek’s overflow. Along the Paper Mill Trail, just off the Creek Road Trail, is an exhibit on managing these protective wetlands that create a unique wildlife habitat. The stone double-arch bridge next to the floodplain exhibit was built in 1847. The fall line on the Pennypack Creek was the natural choice for fording the creek back to Indian days. William Penn was not so patient in waiting for the tide to take the water away each day and in 1683 he asked that “an order be given for building a bridge over the Pennypack.” Each male resident was taxed in either money or labor to build the bridge, which, when completed in 1697, became the first Three Arch Stone bridge in America. Designated a National Civil Engineering Landmark, the bridge over Frankford Avenue in Pennypack Park is the oldest stone bridge still carrying heavy traffic in America. Germantown Pike was the first road to be started in Montgomery County, dating to 1687 when funds were allocated for a “cart road” from Philadelphia to the Plymouth Meeting settlement. Later extended to present-day Collegeville, an eight arch stone bridge was built to span Skippack Creek in 1792. An equestrian trail crosses the bridge, which is the oldest bridge in continuous, heavy use in America. Ashland Covered Bridge, built in the days before the Civil War; the adjoining Succession and Flood Plain Trails visit meadow, marsh, pond and forest landscapes.

Theodore Burr built a bridge spanning the Hudson River at Waterford, New York in 1804. He added an arch segment to the multiple truss bridge popular at the time, attaining a longer span. Patented in 1817, the Burr Arch Truss became one of the most common in the construction of covered bridges. The Larkin’s Bridge, a 65-foot long, 45-ton “Burr Arch” covered bridge erected in 1854 and rebuilt in 1881, was relocated to the northeast section of the park in 1972. Larkin’s Covered Bridge is the only remaining legacy of Milford Mills.

In 1850 Albert Fink, a German railroad engineer,

designed and patented a bridge that used a latticework of rods instead of cables to reinforce stiffness. This construction was cheap and sturdy, making the Fink Truss one of the most commonly used railroad bridges in the 1860s, especially favored by the powerful Baltimore & Ohio Railroad, Only one Fink Truss bridge remains in the United States – an abandoned 108-foot span in Zoarsville, Ohio. A wooden reproduction of a Fink Truss is in a field at Warwick County Park for you and your dog to climb.

CANAL LOCK

Pennsylvania’s first canal system was cobbled together in 1815 using 120 locks to stretch 108 miles from the coal fields of Schuylkill County to Philadelphia. Railroads began chewing away at canal business in the 1860s and the last coal barges floated down the Schuylkill River in the 1920s. Today, the only sections of the canal in existence are at Manayunk and Lock 60, built by area name donor Thomas Oakes, at the Schuylkill Canal Park. In 1985 the Schuylkill Canal Association formed to keep the canal flowing and maintain the lock and towpath. In 1988, the area was added to the National Register of Historic Places.

CHAMPION TREES

The Taylor Memorial Arboretum provides a 12-Tree Self-Guided Tour. The collection is especially strong in Far Eastern specimens and spotlights three Pennsylvania State Champion trees: the Needle Juniper, the Lacebark Elm and the Giant Dogwood. Also on the tour is a Dawn Redwood, an ancient tree known only through fossils until 1941 when a botany student tracked down living specimens in rural China. Some of the first seed to come to America resulted in this tree. Liberated from their sun-stealing neighbors of the crowded woods, the “King” and “Queen” White Oaks have spread out into a massive canopy of leaves. The “Queen” measures seventeen feet around at the thickest part of the trunk and the “King” is closer to twenty. The two trees are part of the “Penn’s Woods” collection of 139 trees standing when William Penn arrived to survey his Pennsylvania colony.

The arboreal oldsters reside at the last stop of the nature trail. bacterial infection. Awbury Arboretum in East Germantown was the summer estate of 19th century Quaker shipping merchant Henry Cope. Across the 55 acres are plantings of groves and clusters of trees set amidst large swaths of grss fields in the English landscape garden tradition. Also on the grounds are wetlands surrounding an artificial pond.

BARNS

While many of the Hospital Farm’s buildings have disappeared, the unique dairy barn remains. Built in 1914, it is shaped like a wheel with four spokes. The fame of the hospital’s dairy operation was widespread. In 1961 alone, nine cows produced 1.1 million pounds of milk – more than 300 pounds of milk per cow per day.The Visitor Center is a restoration of a 1923 Sears & Roebuck mail order barn. A century ago Sears sold anything and everything by mail – including kits for building houses and barns. The kit, which could cost as little as a few hundred dollars depending on style, would include rough lumber, framing timbers, plank flooring, shingles, hardware, sash and paint. Usually shipped by train from the west, the barn kit would be loaded onto a freight wagon and hauled to the building site for assembly by local carpenters.

COOL ROCKS

Forty million years ago an igneous explosion occurred underground here and cooled very quickly leaving behind a particularly fine granite rock. Tourists and students of geology alike made the pilgrimage to the Falls of French Creek to study the rock formations. Granite quarries mined the rock and granite from Saint Peters once received an award at the 1893 World’s Columbian Exposition in Chicago as “a fine-grained polished cube, a good building and ornamental stone.” The quarries closed in the 1960s and many pits can still be seen. Today the giant boulders in French Creek are ideal for your dog to sramble on – or just lie in the sun. Mountain in State Game Land #157. The mountain is essentially a ridge of diabase boulders and the trail to the top calls for almost continuous rock-hopping, a technique called bouldering. The basaltic rock provides incredible traction.

And our vote for the coolest thing of all on Philadelphia trails – the “Ringing Rocks” in Ringing Rocks Park where the rocks ping when struck by a hammer – or thud on “dead ” spots.

Home Renovations: Laying Carpet on Stairs

Due to the frequent changes in elevation, it is harder to lay carpet stairs, than, say, your hallway. But do not let that put you off; if you have successfully rented other rooms, then why not the stairs?

Stairs can be carpeted with fitted carpet, on what's known as a runner – a strip of carpet.

Fitting runners to stairs

A woven carpet runner also enables the carpet to be moved occasionally to equalise wear. Old-fashioned stair rods with side clips might be used to hold a runner in place and form part of the stair decor, but it is now a lot more usual to use gripper strips. Unique pin-less grippers are offered for use with foam-backed carpets; the carpet is held in tight jaws. The wooden strips are utilized in pairs, one behind the tread, and one at the bottom of the riser, or you may get a metal version that's already formed into a right angle.

Cut the strips to length, this is crucial: 38mm shorter than the width of the carpet utilizing tin-snips or secateurs for wooden strips, or a hacksaw for the metal type. Nail them into place, omitting the bottom riser. The gap between each pair of wood strips should be just enough to squeeze the carpet down into. Cut the underlay to fit between the rods and tack close to the rods, omitting the bottom tread. No underlay is needed with foam-backed carpet.

Carpeting the bottom step

With a runner, an extra length of carpet is included so that it can be moved up to even out the wear taken on the treads: this is folded under the bottom step. The pile needs to run down the stairs to stop uneven shading and promote longer wear. Begin at the bottom of the stairs. Tack the end of the carpet face-down to the bottom tread, at the back close to the gripper. Lay it down over the tread to the bottom of the last riser, fold it back and tack the fold to the riser and tread. Run the carpet up the stairs, pulling it over the gripper rods and pushing it down between them with a bolster. It should join the landing carpet at the top of the last riser. If there is no carpet on the landing take the stair runner over the top of the final riser, turn under the edge and tack down.

Fitting carpet to the stairs

The fixings for a fitted stair carpet are as for a runner. The additional length of woven carpet is not needed at the bottom, though an underlay will need to be fitted to all of the steps. The gripper rods really should be the full width of the stairs. Fit the carpet from the top of the flight. The landing carpet will need to overlap on to the stairs and down to the bottom of the uppermost riser. The stair carpet should then be stretched over the gripper rods as usual and pushed down between them. Additionally, it will have to be trimmed to fit at the edges. No fixings are required at the edges.

Carpeting spiral stairs

Where the stairs go round a bend, gripper rods can not be used in the usual way. The carpet may be cut or folded to fit the turn.

Woven carpet: Fit the gripper rods just to the treads on winding stairs. Fold the spare carpet, with the fold falling down, and tack it to the bottom of the riser at 75mm intervals. Lay the carpet on top of next rod up and repeat the folding and tracking procedure.

Foam-backed carpet: Omit the pin-less rods altogether on spiral stairs. Tack the carpet to the tread, preferably at the back so that the tacks are not too obvious. Fold down the surplus and tack neatly on the underside of the riser.

How to create an exposed brick wall

Firstly, what you’ll need:

Brick chisel

Small crow bar

Plastic sheets

Scrubbing brush

Brick sealer

Dust mask & eye protection

Step 1

Protective sheets. As you can imagine removing the plaster from your brick wall is messy work! This is particularly important if you have an old house with the original plaster. Whilst it may seem like a bit of work it is definitely worth using plastic sheets (painting drop sheets are perfect) and taping them to your walls and ceiling to completely seal off the area you’re working in. It is also highly recommended to wear a mask to protect your lungs from the plaster dust, and even eye protection as the dust can easily irritate your eyes.

Step 2

Pretty easy to see what’s next. Simply make a hole the plaster using your brick chisel. This is a good chance to expose a small area of the brick, perhaps somewhere hidden, to see if the quality of the brick underneath is good. Once you’ve created a hole, you can either use the chisel or a small crowbar to remove the plaster. Just tap it lightly to get behind the plaster and level it off. Be careful not to damage the bricks with the chisel or crow bar by tapping too hard. When you get to the ceiling and side walls ensure you neatly remove the plaster without damaging adjacent plaster.

Step 3

Once all the bricks are exposed the next step is to clean the bricks. Some people use acid to do this, but this can be messy and dangerous and not really required. Just some warm water and a sponge should be all you’ll need to clean the bricks. Wipe the dust off with the sponge regularly wringing it in the bucket. Repeat this 2 or 3 times replacing the water between each time until most of the dust has been removed from the bricks. If there are cracks or noticeable holes in the bricks now is your change to patch them with some cement. Small cracks and holes are fine, just ones that may impact the look of the wall.

Step 4

Sealing the wall. Various types of sealer are available for sealing bricks. Look out for brick sealers in particular. You can normally choose between gloss and matt with most people preferring a matt solution as it looks more natural. Follow the instructions on the can for applying the sealer, which normally suggest applying it 2 or 3 times. The sealer will also darken the appearance of the bricks with each coat.

Let it dry and you’re done!

Both are elegant, aesthetically pleasing and operate smoothly – they do their job and look good! As to which to choose, it really is up to one's own preference. Wood certainly provides the more natural and traditional look of plantation shutters. The Polycore shutters do not have such a wide range of colors, generally only coming in white, off-white and cream. However, they are well-designed and stylish as well as being significantly cheaper than the usually more desirable wooden plantation shutters.
